These Terms of Service (“Terms”) are a legally binding agreement between you (“you”) and The Creator’s Flow Program (“CFP”, “we”, “us”, “our”) governing your access to and use of our website https://www.thecreatorsflow.co (the “Site”) and any related services, digital products, programs, content, community spaces, and features we provide (collectively, the “Services”).

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Services immediately.

1. AGREEMENT TO TERMS

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes are posted means you accept the updated Terms.

The Services are offered worldwide, but you are responsible for complying with local laws that may apply to you.

Age requirement: The Services are intended for users 18 years or older.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, the Services and all content made available through them (including videos, lessons, audio, text, templates, downloads, graphics, branding, and course materials) are owned by or licensed to CFP and are protected by intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your own personal, non-commercial use only, subject to these Terms.

You must not:

copy, reproduce, distribute, sell, licence, publish, or exploit any CFP content
share login access or course materials with others
record, rip, screen-capture, or re-upload course content (except where explicitly allowed)
use the content to create competing products or training

All rights not expressly granted are reserved.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

the information you provide is true, accurate, and current
you have the legal capacity to enter into these Terms
you are at least 18 years old
you will not use the Services for unlawful purposes
you will not infringe the rights of others

4. USER REGISTRATION AND ACCOUNT SECURITY

You may be required to create an account to access parts of the Services (including course portals/community areas).

You are responsible for:

keeping your login details confidential
all activity that occurs under your account
notifying us promptly if you suspect unauthorised access

We may suspend or terminate accounts where we reasonably believe security has been compromised, misuse is occurring, or these Terms have been breached.

5. PRODUCTS AND SERVICES

CFP provides digital education products and related services, which may include:

online course content and training materials
downloadable assets
community access
live or recorded sessions (where applicable)

We may update, improve, or discontinue any part of the Services at any time.

6. PURCHASES AND PAYMENT

When you purchase through the Site, you agree to provide current, complete, and accurate billing and purchase information.

Payments are processed through Kajabi Payments (and its underlying processing partners). We do not store your full payment card details.

Prices, offers, and availability may change at any time. Where applicable, taxes may be added or calculated at checkout.

7. REFUNDS AND CANCELLATION POLICY

All sales are final. No refunds are offered.

Because CFP products include immediate access to digital content and downloadable materials, you acknowledge that once access is granted, refunds are not available. This helps protect the integrity of our digital products, pricing, and content distribution.

Nothing in this section limits any statutory consumer rights that cannot be excluded under applicable law.

If you are on a payment plan and miss payments, we may pause or remove access until your account is brought up to date.

8. PROHIBITED ACTIVITIES

You agree not to:

violate any law or regulation while using the Services
share, resell, redistribute, or publicly display CFP content
access the Services through automated means (bots, scrapers, scripts)
attempt to bypass security, authentication, or paywalls
upload malware, harmful code, or disruptive content
harass, bully, or threaten other members or CFP staff
impersonate another person or misrepresent affiliation
use the Services to compete with CFP or create materially similar products
collect user data without permission (including emails/usernames)

9. COMMUNITY AND USER-GENERATED CONTENT

If CFP offers community areas or interactive features, you may be able to post content (“Contributions”). You are responsible for anything you post.

You must not post content that is unlawful, abusive, hateful, discriminatory, defamatory, sexually explicit, or that infringes anyone’s rights.

We may remove Contributions and/or restrict access to community areas at our discretion.

10. CONTRIBUTION LICENCE

If you submit Contributions in CFP community spaces (where enabled), you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute that content for operating, promoting, and improving the Services (for example: showcasing testimonials or community wins), unless you request otherwise in writing.

You retain ownership of your Contributions.

11. FEEDBACK AND SUBMISSIONS

If you send ideas, suggestions, or feedback, you agree we may use them without restriction and without compensation to you.

12. THIRD-PARTY WEBSITES AND SERVICES

The Services may include links to third-party websites or tools. We are not responsible for third-party content, services, availability, or privacy practices. Use them at your own risk and review their terms.

13. SITE MANAGEMENT AND ENFORCEMENT

We reserve the right to:

monitor usage for violations of these Terms
restrict or deny access where needed for safety, legal, or operational reasons
investigate suspected breaches and take action (including suspension/termination)

15. TERM AND TERMINATION

share content unlawfully or attempt to evade payment
engage in harassment or harmful conduct

Upon termination, your right to access the Services ends immediately. Sections intended to survive termination (including IP, refunds, liability limits, indemnities) will survive.

16. MODIFICATIONS AND SERVICE INTERRUPTIONS

We may modify or discontinue the Services (in whole or part) at any time.

We do not guarantee uninterrupted access. Maintenance, updates, platform outages, or circumstances outside our control may result in temporary interruptions.

17. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

18. DISPUTE RESOLUTION

If a dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer law requires otherwise.

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we make no warranties (express or implied) regarding:

accuracy, completeness, or reliability of content
outcomes, results, or earnings (you are responsible for your own actions and decisions)
uninterrupted access or error-free operation

Educational content is for informational purposes only and does not constitute legal, financial, medical, or professional advice.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, CFP will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.

Where liability cannot be excluded, it will be limited to the amount you paid to CFP for the Services giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under law (including fraud or death/personal injury caused by negligence).

21. INDEMNIFICATION

You agree to indemnify and hold CFP harmless from claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of:

your misuse of the Services
your breach of these Terms
your infringement of any rights of another person
your Contributions or conduct in community spaces

22. USER DATA

We maintain data you provide to operate the Services. While we take reasonable steps to protect data, you acknowledge that no method of transmission or storage is completely secure.

23. ELECTRONIC COMMUNICATIONS AND SIGNATURES

You consent to receive communications electronically (e.g., email, site notifications). You agree that electronic agreements and signatures are legally valid and satisfy any requirement for written agreements.

24. MISCELLANEOUS

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Our failure to enforce a right is not a waiver of that right.

You may not transfer your rights under these Terms without our consent. We may assign our rights and obligations.
